PRENOTE:
All prenotes must have the drayage rate clearly shown to be considered a valid prenote. Any preapproved charges should also be
shown. If rate is not shown, prenote will not be accepted. Prenotes must always be sent to the applicable terminal (otherwise
prenotes will not be acknowledged).

RATE EXCEPTION:
A SPECIAL RATE QUOTE (SRQ) number is required for any special rates due to volume, drop & pick, special equipment or
points not listed. If an SRQ applies, this MUST be listed on the prenote. If an SRQ is needed, please contact the
terminal servicing the specific ramp or pier involved to determine eligibility.

SPECIALIZED EQUIPMENT CHARGES:
Additional charges may apply for use of specialized equipment which will include reefers and international containers. Please contact the terminal that you will be using to service the move to confirm if any additional charges will apply to the rate. |
F. |
FLIP CHARGE:
This charge will apply when a bad ordered chassis requires a flip. Note that driver detention charges will accrue after 30 minutes.

G. |
POWER DETENTION:
Upon expiration of 1-hours free time, detention charge
of $100.00 per hour applies. For drop trailers or containers 30 minutes free than $100.00 per hour, time starts at arrivial at customers location or in line at customers gate.

H. |
LABOR CHARGES:
$100.00 for the first hour then $100.00 per hour thereafter.
This charge applies to driver assist, driver load/unload and driver count, etc.
NOTE: This is in addition to any lumper charges incurred if the driver is required to perform any of the above services.

I. |
SCHEDULED RAIL DETENTION:
Confirmed dray assignment to wait at the rail for live picks add $85 for scheduling the power unit 30 minutes free and $100/hour thereafter.

J. |
LUMPER:
Cost, plus $25.00. Farruggio’s will pass through the cost of third-party unloading services, plus an additional $25.00 administrative fee.
|
K. |
STOP-OFF:
Add $175.00 to the regular rate. This will provide one free hour at each stop.
NOTE: An out-of-route mileage charge may also apply. Please consult with the
terminal involved to determine the total charges to be incurred.

L. |
CASH ADVANCES:
Cost plus $25.00. Fees are due whenever Farruggio’s is required to make upfront payment for per
diem, detention, demurrage or any other fee due upon equipment pickup.
|
M. |
LAYOVER CHARGE:
Add $250.00 for overnight delay when incurred to provide requested service.
|
N. |
HAZARDOUS MATERIALS:
We are unable to perform any hazmat shipments.
|
O. |
WEIGH/SCALE CHARGES:
Add $80.00 plus the applicable weigh/scale fees. Also, an out-of-route mileage charge to/from the facility will be assessed
to compensate Farruggio’s for any additional mileage. Please consult with the terminal involved to determine the
total charges to be incurred.

P. |
C.O.D.:
Add $50.00 to the regular rate. HOWEVER, the following conditions must be met:
a) All necessary instructions must be completely explained on the prenote,
b) The specific form(s) of payment must also be explained on the prenote,
c) Customer may incur a redelivery charge (see item T below) and/or power detention (see item F above) if the C.O.D. transaction is not completed in a timely manner.

Q. |
FUEL SURCHARGE:
Due to the unpredictable nature of fuel costs, it may be necessary to implement a fuel
surcharge in addition to the regular rate. Should this become necessary, an
effective date will be announced. The surcharge scale is enclosed and will
be based upon the Department of Transportation Central Atlantic Index posted every Monday.
This surcharge will be effective from 12am Tuesday until the following Monday.

IN-BOND SHIPMENTS:
Add 25% to the regular rate for all trailers and/or containers moving in-bond.
|
S. |
EQUIPMENT CLEANING:
It is the consignee’s responsibility to accept the entire contents of the
vehicle; including all cargo, damaged product, spillage, leakage, dunnage, etc. If the consignee does not properly
clean out the empty vehicle, an additional minimum charge of $100.00 will apply. Other additional charges such as: washout
costs, disposal costs, stop-off charges and possible out-of-route mileage charges may also be incurred as needed.

T. |
CHASSIS RENTAL:
a) Standard chassis @ $65.00/day with two day minimum. b) Tri-axle 20 foot chassis @ $200.00/day when available with two day minimum. Please
contact the applicable terminal for specific information.

U. |
STORAGE LIABILITY:
FX supplies yard parking for our customers' loaded or empty equipment when needed.
Although we provide parking, we do not offer any commitment on the level of security.
Under such circumstances FX shall have no liability for theft of the yard-parked trailer or container or its contents.
Neither customer nor customer's insurer will assert any claim against FX on account of theft, pilferage, vandalism, or damage of or from yard-parked trailers and containers.

V. |
REDELIVERY CHARGE:
When Farruggio’s has presented the requested equipment at the Shipper/Consignee facility as instructed by the Customer, and is
subsequently turned away, the regular rate to the facility will be assessed. Also, an additional 50% of the regular
rate will be charged if the equipment is to be returned to the Farruggio’s terminal. A redelivery charge equal to
the regular rate will then be added when the equipment is again presented to the facility for loading/unloading.

W. |
EQUIPMENT ORDERED-NOT USED:
Cancellation of an order must be made prior to dispatch. If equipment is dispatched, the regular rate will be charged. Also, an additional
50% of the regular rate will be charged to return the equipment to Farruggio’s terminal for storage. The Customer will
also be responsible for payment to Farruggio’s for any penalty charges by the railroad or equipment supplier. Equipment detention
charges may also apply.

X. |
OVERWEIGHT EQUIPMENT:
Farruggio's will charge $250.00 per load for all violations, fines, delays, accidents, etc., resulting
from equipment being overloaded. This may involve an axle, axle group(s), or overall gross weight per local, state or federal laws. Customer
will be responsible for all driver detention resulting from any violation. No free time allowed! Customer is responsible for said payment
(and/or reimbursement to Farruggio's) for all costs and fines and legal fees for Farruggio's and it's driver.

Y. |
OVERSIZE EQUIPMENT:
Due to a variety of road restrictions in our operating area, equipment over 96 inches wide or over 45 feet long may
in some instances be deemed illegal to be operated on certain highways or portions thereof. Therefore, Customer is responsible
for all violations, fines, and delays resulting from equipment being deemed overwidth or overlength in accordance
with applicable local, state, or federal laws. Customer is responsible for said payment (and/or reimbursement to Farruggio’s)
for all costs incurred.
NOTE: To avoid violations (when practical), an out-of-route mileage charge may need
to be added to travel a legal but less practical route. Please consult with the terminal involved.

Z. |
ACCESSORIAL CHARGES - APPROVAL/CONFIRMATION:
Upon presentation of charges by fax, approval/confirmation must be received by the applicable terminal within two working days.

AA. |
TERMS:
Full payment is due within 15 days. If payment is not received within 30 days, an additional 1.5% interest per month will be required
as a part of the full payment.
|
AB. |
RELEASED VALUE:
Farruggio’s liability for any loss or damage to cargo will not exceed 400 cents per pound; subject to a maximum of $200,000.00 per
trailer or container. This will apply regardless of whether or not such released value is stated on the bill of lading.

AC. |
UNSAFE CONDITIONS:
Farruggio’s shall not be required to perform any pick-up or delivery services to or from any location which is unsafe or impractical
to operate a vehicle because of (but not limited to):
a) Condition of roads, driveways, alleys, or approaches thereto.
b) Weather conditions.
c) Inadequate loading/unloading facilities.
d) Any riots or civil/labor disturbances.
